By deploying our hardware, logging into the web portal, or signing an on-site briefing via our digital screens, you ("User," "Client," or "Subscriber") agree to be bound by these Terms. If you are accepting these Terms on behalf of a construction company, contractor, or project owner entity, you warrant that you have the legal authority to bind that entity.
1. Description of Service
Digitaltouchology provides a cloud-synchronized, hardware-integrated site management and compliance platform. The Platform is designed to digitize construction workflows through five core pillars:
- The Digital Safety Board: Real-time visibility into site metrics, logistics, and subcontractor tracking.
- Squad Briefings: Touch-based sign-off protocols for daily engineering tasks.
- Toolbox Talks: Mandatory safety video broadcasting with integrated digital signature capture.
- Certificate Vault: Centralized document repository for compliance permits.
- Interactive Whiteboards: Live annotation engines for uploaded blueprints and site maps.
2. Platform Access and Account Security
User Accounts
To interact with the cloud network, users must be provisioned an authorized account by their designated Site Engineer or Administrator. You are entirely responsible for all actions taken under your credentials.
Security Protocols
- Credentials, PIN codes, and access permissions must neverbe shared between site personnel.
- You must notify Digitaltouchology immediately if you discover a security breach, unauthorized layout modification, or credential leak on your active site.
3. Mandatory Compliance & Audit Integrity
Because Digitaltouchology serves as a system of record for construction safety compliance, the integrity of our data logs is non-negotiable.
The Immutable Audit LedgerThe Platform records every single interaction, timeline change, status edit, and touch-signature alongside a unique User ID and timestamp. This data forms a permanent compliance ledger.
A. Digital Signatures & Accountability
When a worker or squad leader signs the touchscreen interface to confirm a task briefing or a Toolbox Talk video viewing, that signature represents a legally binding confirmationof attendance and comprehension. Falsifying signatures or bypassing video playback triggers an immediate violation of these Terms.
B. Dashboard Accuracy
Site Engineers and Project Managers are solely responsible for verifying that the deadlines, sub-contractor headcounts, and risk assessments committed to the Concerns / Actionstable are accurate, lawful, and safe.
4. Acceptable Use Policy
You agree notto engage in any of the following prohibited behaviors:
- Reverse Engineering: Attempting to decompile, isolate, or copy the proprietary real-time sync mechanism or local caching code embedded in our field touchscreen units.
- Data Manipulation: Injecting automated scripts to alter performance metrics, safety trackers, or audit logs.
- Hardware Interruption: Intentionally disconnecting or damaging terminal hardware to disrupt the continuous compliance trail.
- Content Violations: Uploading blueprints, documents, or media files that infringe on third-party intellectual property or contain malicious payloads.
5. Offline Caching & Synchronization Disclaimer
Digitaltouchology utilizes an advanced offline-first frameworkspecifically built for the rugged, connection-starved environments of active construction zones.
- Local Storage: When internet connectivity is lost on-site, the touchscreen terminals securely store sign-offs, annotations, and schedule changes locally on the hardware.
- Sync Dependencies: Data syncs to the central cloud database immediately upon connection restoration. Digitaltouchology is not liable for project delays, data disparities, or auditing gaps caused by continuous local network failures, structural power blackouts, or extended hardware offline periods.
6. Intellectual Property & Uploaded Blueprints
Our Property
The Digitaltouchology software interface, design frameworks, responsive dashboard grids, icons, caching algorithms, and branding elements remain the exclusive intellectual property of Digitaltouchology.
Your Content
When Site Engineers upload site maps, architectural drawings, or CAD files to the Interactive Whiteboardmodule, you retain full ownership of those documents. You grant us a secure, limited, royalty-free license to render, update, cache, and display these files exclusively to your authorized project team members across our web, mobile, and screen frameworks.
7. Limitation of Liability
Digitaltouchology is a project management and compliance-tracking utility. It is nota replacement for physical site supervision, professional engineering sign-offs, or active human safety protocols.
To the maximum extent permitted by law, Digitaltouchology shall not be held liable for:
- Financial Losses: Any direct or indirect cost overruns, missing material delivery fines, or liquidated damages resulting from schedule adjustments made through the platform.
- Regulatory Fines: Fines issued by regional workplace health and safety inspectors (e.g., OSHA) due to a site team's failure to enforce physical training or documentation rules.
- Physical Damages: Any structural accidents, operational failures, or physical site injuries occurring on project grounds.
8. Suspension and Termination
We reserve the right to suspend platform access, lock local touchscreen terminals, or terminate your master subscription without prior notice if:
- You fall into arrears on your subscription or licensing payments.
- A user under your project organization compromises the network security of our real-time synchronization servers.
- There is a documented pattern of systemic safety data falsification within your project group.
9. Governing Law
These Terms shall be interpreted and governed by the laws of the jurisdiction in which Digitaltouchology is legally registered, without regard to conflict of law provisions. Any litigation arising from these terms must be brought before courts operating within that same corporate jurisdiction.
10. Modifications to Service
As smart screens and cloud environments adapt, we may update these Terms to reflect feature additions or new compliance frameworks. We will alert your system administrators via email or dashboard notifications at least 30 days prior to enacting material modifications. Continued platform deployment after that period implies full consent to the new terms.
